[ARCHIVED] FY 2023-24 AB 1600 Report Available for Viewing

Assembly Bill 1600 Reporting

To ensure that mitigation fees associated with development are spent in a timely manner and on projects for which they were being collected, the State Legislature passed a bill known as AB 1600 (the Mitigation Fee Act). This bill applies to developer fees which were increased or imposed on or after January 1, 1989. 

Requirements for Development Impact Fee Reporting

The Mitigation Fee Act (California Government Code, Section 66000 et seq.) requires local agencies that impose Development Impact Fees to present an annual, consolidated report showing the receipt and use of those fees. Additionally, a report must be provided detailing any fees that have been imposed and remain unexpended the fifth fiscal year following receipt of the fee(s). The fees must be deposited in a special account to avoid comingling with the City's other revenues or funds. Interest on each development fee must be credited to that account and used only for those purposes for which the fees were collected. The Annual Status Report must be available for review by the Council within 180 days after the close of the fiscal year represented. 

The AB 1600 report is required to be accessible to the public for viewing at least 15 days prior to the public meeting.  In accordance with this legal requirement, the report for FY 2023-24 (July 1, 2023 to June 30, 2024) has been posted to the City’s website today, November 25, 2024, for public viewing: FY 2023-24 AB 1600 Report for Public Viewing. City Council will review the report for adoption at the regularly scheduled December 10, 2024 City Council meeting. The City Council meeting agenda will be published on the Thursday before the meeting. The meeting will take place at the Veteran's Memorial Building, 209 Surf Street, Morro Bay, CA 93442 at 5:30 pm.
